FAMILY-BASED IMMIGRATION

Often viewed as the primary legal basis for individuals and families to immigrate to the United States. United States citizens and Lawful Permanent Residents (green card holders) can sponsor family members to ultimately receive their own lawful permanent residence in the United States (green card).

Family ties are the main way people immigrate to the United States. This generally involves at least two (2) family members, a petitioner, the United States citizen or Lawful Permanent Resident, who is sponsoring their relative, and the beneficiary, the foreign family member who wishes to immigrate to the United States.

Family-based immigration makes up nearly sixty-five percent (65%) of immigration to the United States. Many different types of immigration cases and considered to be “family-based.”

Permanent Residency

Having permanent residence means that you have finally obtained the “green card.” Permanent residency can be obtained through family sponsorship or certain employment pathways.

A green card or permanent residence allows you to work and live in the United States permanently. Depending on the facts of a specific case, permanent residency can be applied for in the United States or outside of the United States. Being a lawful permanent resident in the United States can sometimes be a long process, but becoming a green card holder provides a sense of security and stability.

Naturalization is the process in which a foreign national can voluntarily become a United States citizen.

There are several requirements an individual must meet before they are eligible to become a United States citizen. Generally, before becoming a United States citizen a naturalization applicant must sit for an interview in front of a USCIS officer. Most applicants must have been lawful permanent residents of the United States for five (5) years. In some limited circumstances, applicants may be able to obtain naturalization or U.S. citizenship in three (3) years. Becoming a naturalized United States citizen is a huge step in one’s life.

Visitor visa

A foreign national who wants to visit the United State must obtain a temporary nonimmigrant visa to enter the United States lawfully.

The majority of temporary visitors come to the United States for leisure or for short-term business. The nonimmigrant visas for short-term business or leisure is the B-1 or B-2 visa, respectively. Sometimes a B-1/B-2 visa is issued for short, temporary travel to the United States. A foreign national wishing to apply for one of these visitor visas must do so abroad before entering the United States. Although the B-1 or B-2 visa is common and many foreign nationals obtain these visas the actual process of receiving these visas can be difficult depending on many factors including the country conditions of the foreign country.

There are several different types of waivers. The type of waiver necessary for an individual’s case depends on the specific issue that makes that individual removable.

Each waiver requires different proof. Common types of waivers include the following:

Waiver after a prior order of removal

The F-1 visa is available to international students wishing to study in the United States for a set period of time at a university, school, seminary, or conservatory. F-2 visas are available for spouses and children of students.

RELIGIOUS WORKERS

Religious workers can qualify for the R-1 visa. This is a temporary nonimmigrant visa available to people who have been offered jobs as religious workers in the United States.

A person seeking the R-1 visa must have been a member of a legitimate religious denomination for at least two (2) years and must have a job offer from an affiliate of the same religious denomination in the United States. R-1 is available for both clergy and lay religious workers and can be granted for up to thirty (30) months.

Representing and advocating for individuals for immigrants facing deportation, removal, exclusion, or recession from the United States.

This involves appearing in front of an Immigration Judge in Immigration Court formally known as the Executive Office of Immigration Review. In removal defense cases, an individual facing removal or deportation must apply for a form of relief from the pending charge of removability. There are several different avenues for relief that can be sought depending on the facts of each individual case.

Employment-based/

business

Employment or business-based immigration covers a wide swath of the immigration landscape.

A foreign national may pursue immigration benefits based upon a stable employer-employee relationship or if there is an employer that wishes to sponsor a potential employee for lawful permanent residence based on their skills. An employer may also pursue a labor certification, Form ETA-9089, with the Department of Labor for a current or prospective employee. There are certain situations where an employer can also sponsor an employee for employment-based nonimmigrant visas.

A foreign national is possibly eligible for an immigrant visa through employment. There are five (5) employment-based immigrant visa categories.

EB-1:Persons of extraordinary ability in the sciences, arts, education, athletics, or business, outstanding professors and researchers, or Multinational managers or executives

EB-2:Persons holding advanced degrees of and persons of exceptional ability

EB-3:Skilled workers, professionals, and unskilled workers

EB-4:Certain Special immigrants

EB-5:Immigrant Investors

INVESTMENT IMMIGRATION

EB-5 VISAS: The United States’ immigration laws have developed programs in which investors and their families can apply for permanent residency by investing a commercial enterprise that creates 10 permanent full time jobs for qualified U.S. workers.

This is known as the EB-5 program. Congress created this program to stimulate job growth and economic development.

E-2 VISAS: Foreign nationals of certain countries that hold treaties with the United States can also obtain a specific nonimmigrant visa by investing a substantial amount in a new or existing business enterprise in the United States. The investment must be substantial. This visa is temporary and not a permanent immigration solution.

PERMANENT RESIDENCY THROUGH EMPLOYER SPONSORSHIP

The PERM or Labor Certification Process is a key step in part of a foreign national’s journey toward permanent residence through sponsorship by a U.S. based employer.

There are several parts of the PERM process that involves assessing the fair market value for the position to be filled, making a good faith effort to recruit qualified U.S.citizen workers for the position, and ultimately filing the ETA-Form 9089 with the Department of Labor. The PERM process is a very detail-oriented process that is incredibly time-sensitive.

Labor certifications

A labor certification is an employment based opportunity that could possibly lead to permanent residency in the United States.

This process involves the U.S. employer recruiting U.S. citizen workers and proving that there are no minimally qualified U.S. citizen workers for an available position. This can turn out to be a lengthy, detail oriented process. Although, once certified by the Department of Labor, an individual, through an employer, can pursue an application for permanent residency with USCIS.

H-1B VISAS

The H-1B is a temporary nonimmigrant visa that is available to foreign nationals through employer sponsorship.

The H-1B visa is issued for foreign nationals that hold a specialty occupation which is defined as the theoretical and practical application of a body of specialized knowledge and requires the visa holder to have at least a bachelor's degree or its equivalent. The U.S. Government only approves a certain number of H-1B visas each fiscal year. There are certain professions and employers that are not subject to this U.S. Government-issued cap.

H-1B1 VISAS

Born out of the Singapore, the United States Free Trade Agreement and the Chile-United States Free Trade Agreement the H-1B1 is available for nationals of Chile and Singapore.

The H-1B1 is a variant of the H-1B visa and has similar eligibility requirements. A person pursuing the H-1B1 visa must work in a specialty occupation. A key difference between the H-1B1 and the H-1B is that there is not a six (6) year limit and that the H-1B1s can be renewed in one (1) year increments.

H-2B VISAS

The H-2B visa is a temporary work visa that can be obtained through employer sponsorship.

The job position must be temporary and must fall within three specific categories: one-time need, seasonal need, peak load, or intermittent. The employer must prove that the job position that the temporary workers are being requested falls under one of these three categories. The employer in the U.S. must also recruit U.S. citizen workers for the position and further proof that there are not enough U.S.citizen workers that are able, willing, and qualified to do the work. Employers must first seek and obtain a temporary labor certification with the Department of Labor. Once the employment is certified by the DOL, the employer can then petition for the H-2B visa with USCIS using Form I-129.

L-1A Visas

The L-1A nonimmigrant classification allows companies in the United States to transfer managers or executives from an affiliated foreign office such as a parent company or subsidiary.

A foreign entity can utilize the L-1A to send an executive or manager to the United States with the purpose of establishing an affiliated branch or office in the United States.

O-Visas

The O visa is separated into two classifications. The O-1A and the O-1B classification. The O-1A requires an individual to demonstrate extraordinary ability in science, business, education, or athletics

The O-1B classification requires an individual to demonstrate extraordinary ability in the arts or extraordinary achievement in motion picture or television. An employer in the U.S. must petition for the individual to demonstrate extraordinary achievement.

tn visas

The TN nonimmigrant classification permits professionals from Canada and Mexico to enter the United States and engage in business activities for a sponsoring employer.

The TN is eligible only for certain professions. Certain professions include but are not limited to engineers, lawyers, pharmacists, and teachers.
